Introduction
This Privacy Policy (“Policy”) describes how AGENTARI TECHNOLOGIES PRIVATE LIMITED (“Company”, “we”, “our”, or “us”), operating the platform ‘ARI’, collects, uses, stores, and protects personal information when User (defined below) accesses or uses ‘ARI’ and the Company’s services (“Platform”).
The Platform is designed to facilitate talent discovery, collaboration, and professional engagement for artists, creators, agencies, talent managers, and other industry professionals. It provides technology-driven and AI-enabled tools to structure and manage end-to-end communication, workflow coordination, and collaboration processes, including project initiation, negotiation, task allocation, content exchange, feedback management, and execution tracking. We are committed to protecting information of the User in accordance with applicable laws including but not limited to the Information Technology Act, 2000, Digital Personal Data Protection Act, 2023 and the rules framed thereunder.
By visiting the Company’s Platform, providing information or availing the Company’s product/service, the User expressly agrees to be bound by the terms of this Policy along with the applicable Terms of Service. While accessing or using the Company’s Platform, the User gives the Company’s explicit consent to collect, use, share or otherwise process the information in accordance with this Policy. If the User does not agree, it is advisable to not access or use the Company’s Platform or services.
The User acknowledges that the User is disclosing Personal Information (defined below) voluntarily. Prior to the completion of any registration process on the Company’s Platform or prior to availing of any services offered on the Company’s Platform, if the User wishes not to disclose any Personal Information, the User may refrain from doing so; however if the User doesn’t provide information that is requested, it is possible that the registration process would be incomplete and/or the User would not be able to avail of the Company’s services and/or use the Platform.
This Policy applies to all Users as mentioned below in paragraph II(k), irrespective of their role or capacity on the Platform. The nature and extent of personal data collected may vary depending on the type of account created, the services availed, and the User’s interactions with the Platform.

Definitions
“Biometrics” shall mean the technologies that measure and analyse human body characteristics, such as fingerprints, eye retinas and irises, voice patterns, facial patterns, hand measurements and DNA for authentication purposes.
“Minor” means a natural person below the age of eighteen years.
“Cyber incidents” means any real or suspected adverse event in relation to cyber security that violates an explicitly or implicitly applicable security policy resulting in unauthorised access, denial of service or disruption, unauthorised use of a computer resource for processing or storage of information or changes to data, information without authorisation.
“Cyber security” means protecting information, equipment, devices, computer, computer resource, communication device and information stored therein from unauthorized access, use, disclosure, disruption, modification or destruction.
“Data” means a representation of information, knowledge, facts, concepts or instructions which are being prepared or have been prepared in a formalised manner, and is intended to be processed, is being processed or has been processed in a computer system or computer network, and may be in any form (including but not limited to computer printouts magnetic or optical storage media, punched cards, punched tapes) or stored internally in the memory of the computer.
“Data Protection & Security” Anyone collecting personal & customer information must fairly & lawfully process it only for limited, specifically stated purposes and use the information accurately and in a way that is adequate, relevant and not excessive, and retain the information/records no longer than absolutely necessary, process the information in accordance with law and keep the information secure and never transfer the information outside the country without adequate protection.
“Password” means a secret word or phrase or code or passphrase or secret key, or encryption or decryption keys that one uses to gain admittance or access to information.
“Personal Information” means any information that relates to a natural person (individual), which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person, i.e., Name, Address, mobile Number, email id, Date of birth etc.
“Processing” in relation to personal data, means an operation or set of operations performed on personal data, and may include but not be limited to operations such as collection, recording, organisation, structuring, storage, adaptation, alteration, retrieval, use, alignment or combination, indexing, disclosure by transmission, dissemination or otherwise making available, restriction, erasure or destruction.
“Third Party” shall mean any individual or entity other than the User and the Platform, including but not limited to service providers, vendors, partners, advertisers, analytics providers, and any other external persons or organisations with whom the Platform may share or from whom it may receive information in connection with the provision of its services.
“Users” shall mean any individual or entity that accesses, registers on, or uses the Platform in any manner, including but not limited to the following categories:
For the purposes of this Policy, all such persons shall be collectively referred to as “Users”, irrespective of their role, capacity, or manner of use of the Platform.

Age Requirement
The Platform is intended for use only by individuals who are eighteen (18) years of age or older. By accessing or using the Platform, the User represents and warrants that the User is at least 18 years old. Notwithstanding the foregoing, if a User is below the age of eighteen (18) years or is not a natural person, such User is advised to refer to paragraphs XXVII to XXIX of this Policy.

Collection of Information
In the course of providing and improving its services, the Platform collects, receives, and generates various categories of information from Users. Such information may include, without limitation, account-related data, transactional records, communications, user-generated content, and other information necessary for the operation of the Platform.
Personal Information is collected from the User in a variety of ways when the User interacts with the Company through the Company's services, such as installing or accessing; creating an account on the Platform; requesting customer service or contacting us; conducting a transaction where the Company collects Personal Information, including when required by law and regulations; submitting a testimonial, rating or review, or other user-generated content that may be posted.
Types of Information collected by us:
3.1 Creator/Artist Information
During account creation or onboarding, the Company may collect:
Personal Identifying information such as name, stage name, date of birth, permanent and temporary addresses and phone numbers; email Id, age, personal description, profile photograph and any other.
Username, profile details, portfolio content.
Content of reviews and e-mails to us.
Voice recordings when the User calls us.
Social Media handles including YouTube, Instagram, X (Twitter), LinkedIn, SnapChat and any others.
This information enables brands, agencies, and collaborators to identify and connect with creators across digital platforms, and shall be used for Account Verification, Platform Notifications, Communication regarding collaborations and Customer Support.
3.2 Talent Managers and Agency Information
The Platform may collect and process information relating to talent managers, agencies, or similar representatives, including but not limited to:
Organisational or business information such as entity name, registration details, business address, and authorised representatives.
Contact information including but not limited to phone number(s) and email address(es).
Information relating to represented talent, including but not limited to client rosters and associated profiles.
Professional and transactional information relating to collaborations, campaigns, and engagements.
3.3 General Information
The Platform may collect certain general information from all Users, irrespective of their category, including but not limited to:
Account registration and login information.
Communications and interactions with the Platform.
Feedback, reviews, and support queries.
Any other information voluntarily provided by Users in the course of using the Platform.
3.4 Automatic Information
The Platform may automatically collect certain technical and usage-related information when Users access or interact with the Platform. Such information may include but not be limited to:
IP address and approximate location derived from such IP address.
Device information, including but not limited to device type, operating system, browser type, and device identifiers.
Log data, including but not limited to login timestamps, access times, and activity logs.
Usage and interaction data, such as pages viewed, features accessed, search queries, and duration of visits.
Cookies and similar tracking technologies, including but not limited to browsing and usage history on the Platform.
Performance and diagnostic data, including but not limited to error reports, crash logs, and system activity.
Network and connectivity information.
Where applicable, information relating to User interaction with content, including but not limited to viewing history and engagement metrics.
The Platform does not access or collect images, videos, or other media from a User's device without the User's explicit action or consent.
3.5 KYC and Verification Information
Where required under applicable law or for verification purposes, the Platform may collect Know-Your-Customer (“KYC”) information, either directly or through authorised third-party service providers. Such information may include but not be limited to:
Identity verification information — Aadhaar (in compliance with applicable law), PAN, passport, voter ID, or driving licence, Goods and Service Tax Certificate.
Proof of address documents (such as utility bills or government-issued records).
For payment processing, invoicing, and regulatory compliance, financial and banking details such as bank name, bank account number, IFSC code, account type, credit card details, debit card details, UPI ID, SWIFT code (for international payments), billing name and shipping address.
Such other documents as may be prescribed by regulatory authorities from time to time.
For business entities, additional documentation may be collected to establish legal status and authority, including but not limited to incorporation documents, partnership deeds, registration certificates, tax registrations, authorisations, board resolutions and details of beneficial owners. The Platform may also undertake verification processes, including video-based identification, where required under applicable law.
3.6 Account Authentication Information
The Platform collects and processes certain authentication-related information to enable secure access to User accounts. This may include but not be limited to login credentials such as Passwords, one-time passwords (OTPs), authentication tokens, and other security-related information required for account verification and access control.
All Passwords are securely processed using industry-standard cryptographic hashing algorithms (including Argon2) prior to storage. The Platform does not store Passwords in plain text, and such credentials are subjected to a one-way hashing process to ensure that the original Password cannot be retrieved.
The Platform may also implement multi-factor authentication mechanisms, including OTP-based verification or authenticator-based systems, to enhance account security. Users are responsible for maintaining the confidentiality of their authentication credentials and for all activities carried out through their accounts.
3.7 Biometric Information
The Platform may, where necessary and in compliance with applicable law, collect and process certain biometric information of Users for purposes including identity verification, authentication, fraud prevention, security, or regulatory compliance.
Such biometric information may include, but is not limited to, facial recognition data, voice samples, or other similar identifiers collected through video-based verification processes or platform-enabled features.
Biometric information shall be collected only with the User's explicit consent and shall be used strictly for the specific purpose for which it is collected. The Platform implements appropriate technical and organisational safeguards to ensure the secure processing and storage of such sensitive data.
The Platform does not sell, rent, or otherwise commercially exploit biometric information and does not retain such data for longer than necessary for the purpose for which it was collected, unless required under applicable law.
3.8 Professional and Commercial Data
The Platform shall collect and process certain professional and commercial information relating to Users, including but not limited to:
Professional background, work history, and past collaborations.
Brand preferences and areas of interest.
Participation in campaigns and related engagement metrics.
Payment, billing, and transaction-related information.
3.9 Creator Pricing and Commercial Information
Users may, at their discretion, provide commercial and pricing-related information to facilitate potential collaborations and engagements on the Platform. Such information may include but not be limited to:
Indicative rates for content creation and services, including but not limited to photo posts, video content, short-form content (e.g., reels/shorts), stories, long-form content, and event appearances.
Platform-specific pricing across channels such as Instagram, YouTube, TikTok, LinkedIn, X (formerly Twitter), blogs, or newsletters.
Pricing ranges based on engagement levels.
Preferred currency for transactions.
Advance payment requirements and credit terms.
Pricing for content usage rights, including but not limited to organic usage, paid promotions, whitelisting/boosting, website usage, and long-term licensing.
3.10 Travel and Logistics Preferences
The Platform collects certain information upon a user’s access to and use of the Platform, including travel and logistics preferences of creators or artists at the time of account creation. For certain collaborations, events, performances, or campaigns, travel arrangements may be required.
This information is collected for a confirmed collaboration or event and is used solely for logistical planning and for coordinating professional engagements. Such information shall be disclosed or made accessible to brands, agencies, event organizers, or other relevant parties strictly on a need-to-know basis.
The Platform may collect limited travel preferences including but not limited to:
3.11 Browsing Information
When Users access or interact with the Platform, certain technical and usage-related information may be automatically collected to understand user behaviour, enhance functionality, and ensure platform security. Such information may include but not be limited to session-level data such as pages accessed, navigation flow, session duration, referring or exit URLs, and access timestamps.
3.13 User-Generated Content
Users may upload, submit, or share content on the Platform, including but not limited to portfolios, media kits, photographs, audio-visual content, campaign materials, and collaboration-related documents. Such content is processed and stored solely for the purposes of enabling Platform functionality, facilitating collaborations, and allowing Users to present their professional profiles to other Users.
3.15 Collaboration and Transactional Information
Where Users engage in collaborations or commercial activities through the Platform, the Platform may process information relating to such engagements, including but not limited to collaboration scope, deliverables, negotiation progress, agreed terms, and status tracking. Such information is used to facilitate collaboration management and provide visibility into ongoing and completed engagements.
3.16 Media Content Handling
Users may upload or share images, videos, or other multimedia content as part of their profiles or collaborations. Such content may be processed to support portfolio display, talent discovery, collaboration execution, and, where applicable, verification processes. Users remain responsible for ensuring that any content uploaded complies with applicable laws and does not infringe third-party rights.
3.12 Communication Information
Where users communicate through the Platform or use platform-integrated communication tools, the Company may collect and process certain communication-related information including but not limited to:
Messages exchanged between users through the Platform.
Collaboration requests or enquiries.
Responses to brand or agency outreach.
Customer support communications.
Notifications or platform messages.
3.14 Search and Platform Activity Information
The Platform may collect information relating to user searches and other activities performed on the Platform, including but not limited to:
Search queries.
Filters applied during discovery.
Creator or brand profiles viewed.
Collaboration opportunities accessed.
Engagement with platform features.
3.17 Analytics and Insights Data (Ari Analytics)
The Platform may collect, process, and analyse certain User data to provide analytics and insights through its “Ari Analytics” feature. This may include:

Preferences and Platform Settings
The Platform may allow Users to configure certain operational, communication, and collaboration-related preferences, including but not limited to notification settings, communication preferences, and other platform functionalities.
Such preferences may include but not be limited to settings relating to collaboration opportunities, automated sharing of profile or portfolio information, and other user-configurable features.
These preferences are collected and stored to enhance User experience, personalise Platform functionality, and facilitate efficient communication and collaboration between Users.

Account Authentication via Google OAuth
To ensure the security, authenticity, and integrity of user accounts on the Platform, the Platform uses Google OAuth 2.0 authentication. Users are required to sign in using Google Sign-In, during which the Platform may receive the following information from Google:
Such information is processed solely for user identification and authentication, account creation and management, secure login and session management, and preventing fraudulent or unauthorized accounts.
1. Access Tokens and Security Measures
As part of the OAuth process, Google may issue authorization codes, access tokens, or refresh tokens. The Platform uses these tokens strictly for authentication and account management purposes, using industry-standard encryption (HTTPS) for transmission, storing tokens securely on a need-to-know basis, and not sharing tokens with unauthorized third parties.
2. Use of Google User Data
Any information obtained through Google authentication is used strictly for user authentication and account creation, account verification and security management, and enabling the user to access and use the Platform. The Platform does not sell, rent, or commercially exploit Google user data obtained through the authentication process.
3. Compliance with Google API Services User Data Policy
The Platform’s access to and use of information is subject to Google’s OAuth 2.0 Policies and the Google API Services User Data Policy.
4. Scope of Permissions Requested
Where additional functionality is enabled, the Platform may request the following permissions with explicit user consent:
4.1 Gmail Access
If granted, the Platform may read email content, send emails on the user’s behalf, organise and label emails, and modify or delete emails where necessary for workflow automation. This access is used solely to enable collaboration management, automated responses, lead detection, and communication workflows.
4.2 Google Calendar Access
If granted, the Platform may create new calendars, create, edit, and manage calendar events related to collaborations or engagements, and update or modify events created through the Platform.
4.3 Google Drive Access
If granted, the Platform may upload files related to collaborations, organise and manage files within the user’s Drive, and share files with authorized collaborators added to the Platform.
Users retain full control over the permissions granted to the Platform and may revoke access at any time through their Google Account settings. Upon revocation, certain features of the Platform may no longer function as intended.
4.4 Data Usage Limitation
All data accessed through these permissions is used strictly for providing Platform services and features; is not sold or used for advertising purposes; and is processed in accordance with applicable laws and Google API Services User Data Policy. The Company’s use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
4.5 Revocation of Access
Users may revoke the Platform’s access to their Google account at any time through their Google Account permissions settings. If access is revoked, the Platform may no longer be able to authenticate the user through Google Sign-In, certain features may become unavailable, and the user may be required to re-authenticate.

AI Assistant (ARI)
The Platform uses artificial intelligence and machine learning technologies under the name "ARI" to process User data for purposes such as content recommendations, talent discovery, matching, analytics, and improving platform functionality.
All data provided to ARI is used solely to provide the requested platform services and is not used for advertising or sold to third parties. Users may revoke Gmail access at any time through their Google account permissions.
Such processing may be performed using third-party AI service providers, including but not limited to cloud-based AI infrastructure providers.
The purpose of this processing is to enable functionality such as:
Identifying potential collaboration opportunities
Generating draft responses to collaboration enquiries
Summarizing communication threads
Assisting with deal management and workflow organization
AI-generated outputs are automated suggestions and may not always be accurate or complete. Users remain responsible for reviewing and verifying any communication, agreements, or decisions before relying on such outputs.

Data Generated by the Platform
The Platform may share certain data with third-party service providers, including but not limited to AI technology providers such as Google and its AI services (including but not limited to Gemini), solely for the purpose of enabling AI-driven features and services.
Outputs generated by AI systems are automated and may not always be accurate, complete, or suitable for specific purposes. Users are advised to exercise independent judgment before relying on such outputs.
The Platform may use anonymised and aggregated data to improve AI systems.
User data may be transferred to and processed in jurisdictions outside India, subject to applicable legal safeguards.
The Platform may use automated systems to analyse User data and provide recommendations, rankings, or matches. Such processing does not constitute solely automated decision-making with legal or similarly significant effects.
The Platform implements appropriate technical and organisational measures to ensure that data processed through AI systems remains secure.
Users represent that they have the necessary rights and permissions to upload content and that such content may be processed by AI systems for platform functionality.
The Platform may generate operational data while providing services, including but not limited to:
Deals and Opportunities Data: When creators, brands, or agencies interact through collaboration opportunities on the Platform, certain transactional and operational data may be generated and stored. This may include but not be limited to:
AI Usage Logs: Where the Platform uses artificial intelligence to assist with features, the Platform may maintain limited system logs. These logs may include but not be limited to:
Such information is used strictly for system performance monitoring, troubleshooting, security, and improving AI-powered features.
OTP and Verification Records: To maintain account security and verify user contact details, the Platform may generate and store records related to OTP authentication processes. These records may include:
Data Usage and Retention: Data generated by the Platform is used solely for operational, security, analytical, and service improvement purposes. The Platform retains such information only for as long as necessary to fulfill these purposes or comply with applicable legal or regulatory requirements.

How the Company Uses Your Information
The Platform uses certain user-provided and system-generated data to operate its services, automate workflows, facilitate brand collaborations, and improve operational efficiency.
Automated Brand Detection
The Platform may automatically analyze incoming emails to identify potential brand collaboration opportunities. Data used may include full email body text, artist or creator stage name, and email timestamps. Third-party services used include Google Gemini AI models and AWS Bedrock AI services as a fallback.
Automated Email Replies
The Platform may generate suggested or automated responses to brand inquiries. Data used may include full email conversation threads, artist pricing or commercial preferences, travel or logistical requirements, manager contact details, and deal negotiation context.
Lead Summarization
The Platform may automatically summarize email conversations related to potential brand collaborations using all emails within a conversation thread and deal-related information extracted by the Platform.
Deal Management
The Platform may extract and organize deal-related information from communications to track and manage the lifecycle of brand collaborations from inquiry through negotiation, execution, invoicing, and completion.
WhatsApp Notifications
The Platform may send notifications through messaging services, including WhatsApp, when manager attention or action is required. Data used may include artist name, brand name, deal budget, deliverables, timeline, and manager phone number.
Calendar Synchronization
The Platform may create or update calendar entries related to confirmed collaborations or scheduled events via the Google Calendar API, helping creators and managers maintain accurate schedules.
Address Validation
When Users enter address details, the Platform may validate such information using third-party services such as Google Places API or similar providers, solely for ensuring accuracy.
Failure Monitoring (Internal Operations)
The Platform maintains internal monitoring systems to detect and resolve technical failures, including operation type, email or conversation identifiers, error messages, and AI model names used in processing.
Identity Verification
The Platform may collect identity documents where necessary for compliance or payment processing. Documents are stored in secure cloud storage infrastructure (such as AWS S3).
Financial Operations
The Platform may collect financial and billing information required to facilitate payments, including bank account details, IFSC codes, tax identification numbers, and billing addresses, to generate invoices, process payments, and comply with tax and financial regulations.
Analytics
The Platform may use analytics tools, including services provided by Google Analytics, to understand usage patterns, improve platform functionality, and generate insights through Ari Analytics. These tools may use cookies or similar technologies to collect information about User interactions with the Platform.

Automated Processing and AI Assistance
Certain features of the Platform may use automated tools or artificial intelligence to analyze communications, summarize content, or suggest responses. Such processing is intended only to assist users and does not constitute automated decision-making that produces legal or similarly significant effects. Final decisions regarding collaborations, negotiations, or agreements remain solely with the users. Ari Analytics may use automated processing and AI-based systems to interpret User queries, analyse underlying data, and generate structured responses in natural language.

Profile Visibility
Certain profile information provided by creators or artists may be visible to brands, agencies, or collaborators on the Platform for the purpose of talent discovery and professional engagement. Users may control certain profile visibility settings through their account preferences.

The Platform may share User information only in limited and necessary circumstances, including but not limited to:
The Platform does not sell, rent, or otherwise commercially trade User Personal Information to third parties.

Legal Basis for Processing
Users’ personal data is processed only for lawful purposes and based on one or more of the following legal grounds:

Cross-Border Transfer of Personal Data
The Platform may store or process personal data on secure cloud infrastructure operated by third-party service providers located outside India. Where such transfers occur, the Platform ensures that appropriate safeguards and contractual protections are implemented in accordance with applicable data protection laws. By using the Platform, users consent to the transfer, storage, and processing of their personal data in jurisdictions where the Company’s service providers operate, subject to appropriate security measures.

The Platform may use cookies, session tokens, log file information and similar technologies to (a) remember information so that the User will not have to re-enter it during re-visits; (b) provide custom, personalized content and information; (c) monitor pages viewed; (d) track User entries, submissions, views and so on; (e) analyze platform usage, improve platform performance and functionality. Users may control the use of cookies through their browser settings. However, disabling certain cookies may affect the functionality of the Platform.

Data Breach Notification
In the event of a personal data breach, the Platform will take appropriate steps to investigate, mitigate, and address the incident. Where required under applicable law, including but not limited to the Digital Personal Data Protection Act, 2023, the Platform shall:

Consent and Withdrawal
By registering on the Platform or enabling specific features, users provide consent for the processing of their personal data as described in this Privacy Policy. Withdrawal of consent may affect the availability of certain Platform features.

Platform Intermediary Disclaimer
The Platform functions as a technology intermediary that facilitates discovery, communication, and collaboration between users. The Platform does not guarantee the success, completion, or performance of collaborations, campaigns, or commercial engagements between users.

Data Minimization Clause
The Platform collects only such Personal Information that is reasonably necessary for providing its services and operating the Platform.

Where Gmail integration is enabled, certain processed data may be stored temporarily for approximately 30 to 60 days, after which such data is deleted or anonymized unless required for security or legal purposes.

Payments
The Platform may or may not facilitate collaboration opportunities and deal management between Users. However, the Platform does not currently process payments between Users. Payments related to collaborations and/or assignments and/or engagement are executed directly between the parties.
XXIV
No Agent and/or Employer Relationship
The Platform functions primarily as a technology intermediary that enables discovery, communication, and collaboration between Users. The Platform does not act as an agent, employer, or representative of users and does not control or guarantee the performance of collaborations, agreements, or commercial arrangements entered into between users.

Account Deletion
Users may request deletion of their account by contacting the Platform. Upon verification of such a request, personal data will be deleted or anonymized within 30 to 60 days, except where retention is required by law or for legitimate operational purposes. Upon deletion, the Company may retain certain transactional and deal-flow records for a limited period for purposes of audit, legal compliance, dispute resolution, and internal review. Notwithstanding the foregoing, the Company may retain anonymised and/or aggregated data and derived insights for analytical, research, and platform improvement purposes, in a manner that does not identify the User.

The Platform may feature accounts, profiles, or content representing pets or animals (“Pet Accounts”). Such Pet Accounts must be created, managed, and operated solely by a natural person who is the pet’s owner, handler, or an authorized representative. By creating or operating a Pet Account, the User represents and warrants that they have the legal authority to act on behalf of the pet. The Platform does not recognize pets or animals as independent users, and all rights, obligations, and liabilities in relation to any Pet Account shall vest solely with the human User operating such account.

The Platform may feature accounts, profiles, or content representing artificial intelligence avatars, virtual influencers, or other non-human personas (“AI Avatar Accounts”). Such AI Avatar Accounts must be created, managed, and operated solely by a natural person or a legally recognised entity that owns, controls, or is authorised to operate such AI Account. The Platform does not recognise AI Avatar Accounts as independent users or legal persons, and all rights, obligations, and liabilities in relation to any AI Avatar Account shall vest solely with the human User or entity operating such account.
